A restriction has been implemented on the granting of annual leave for the last three years of work

June 1, 2020

Paragraph 8 of Article 6 'Implementation and Application of the Law' of the Law on the Approval, Entry into Force and Implementation of the Labour Code of the Republic of Lithuania stipulates that "Employees who, prior to the entry into force of the Labour Code, have unused annual leave for more than three years of employment, shall be entitled to use it by 1 July 2020."

Art. 127(5) of the LC establishes that the right to take one’s entire annual leave or part thereof (or to receive monetary compensation therefor in the case established by this Code) shall be lost three years after the end of the calendar year during which the right to full annual leave was acquired, except for cases when the employee was, in actuality, unable to take it.

In our software we have created a functionality enabling our clients to restrict the granting of annual leave to their employees according to Art. 127(5) of the LC, if they decide to do so, however, we have also provided our clients with the option not to restrict the granting of annual leave to employees.
